These Terms of Service (the "Terms") govern your use of MindMuse (the "Service"), a mental-health journaling and AI companion service provided by AKA AI ("we," "us," or "the Company"). Because the Service is offered in Korea, Japan, and the United States, these Terms apply to the extent permitted by, and are subject to, the mandatory consumer-protection laws of your jurisdiction.
1. Definitions
- "Service": All features of the MindMuse app and website, including journaling, AI-based emotional analysis, Muse Chat, sleep and medication tracking, and the Connect community.
- "User": Any person who agrees to these Terms and uses the Service.
- "Account": A personal authentication unit created via email/password or Google sign-in.
- "Content": All text and data (journal entries, chat messages, medication records, Connect posts and comments, etc.) entered into the Service by a User.
- "AI Analysis": Emotional, cognitive, and somatic analysis and conversational replies generated by Google Vertex AI (Gemini family) large-language models.
- "Connect": A community feature that lets Users share self-reflection and mental-health recovery experiences with other signed-in Users in a discussion-board format. Connect includes posts, comments, replies, reactions (likes), and reporting.
2. Acceptance and Changes
- These Terms become effective between you and the Company the moment you complete the consent step during sign-up.
- We may update these Terms. We will provide at least 7 days' advance notice (30 days for changes that are unfavorable to Users) via in-app notice or email.
- If you do not object before the effective date of the change, you are deemed to have accepted it. If you do not agree, you may stop using the Service and delete your account.
3. Important Health Disclaimer (Medical Disclaimer)
⚠️ MindMuse is not a medical device and is not intended for diagnosis, treatment, or prevention of any condition.
- The Service, AI analysis, and AI replies are provided only for general self-reflection purposes.
- The Service is not a substitute for consultation, diagnosis, or treatment by qualified mental-health professionals (psychiatrists, clinical psychologists, counselors, etc.).
- In an emergency — including suicidal thoughts, acute depression, or panic — please contact the following resources immediately:

- AI responses may contain errors, bias, or hallucinations. We do not guarantee the accuracy or completeness of AI output.
- Medication tracking is a logging tool only and does not provide drug-interaction checks or medical guidance. Always consult your physician or pharmacist.
4. Account and Eligibility
- You must use a valid email address or Google account to register. You must be at least 13 years old (US), 14 years old (Korea), or 16 years old (EU/Japan).
- You must not share account credentials with third parties. You are responsible for all activity on your Account.
- We may refuse registration or suspend/terminate an Account in the following cases:
- Using another person's information
- Submitting false or inaccurate information
- Violating these Terms or applicable law
- Attempting to register via automated tools (bots, etc.)
5. Provision of the Service
- The Service is generally available 24/7 but may be temporarily suspended for maintenance, emergencies, system failures, or force majeure.
- The Service currently includes:
- Journal (text) entry and storage
- Sleep and medication tracking
- AI-based emotional, cognitive, and somatic analysis
- Muse Chat (AI conversation)
- Visualization (trend dashboard)
- Connect community — posts, comments, replies, reactions, reports, and admin announcements
- We may modify Service features for operational or technical reasons and will provide prior notice of material changes.
- To operate the Service, we may send activity notification emails (such as new comments, replies, and moderation actions). These messages are transactional notices incidental to your use of the Service, not marketing communications. You may turn individual notification categories on or off in Settings, although safety- or policy-related notifications may be sent regardless of preference.
6. Your Content
- You retain all rights and ownership in Content you submit (journals, chats, medication records, etc.).
- We use your Content solely to provide the Service—storage, retrieval, and transmission to AI for analysis—and for no other purpose.
- We do not use your Content for AI model training, and our AI sub-processor (Google Vertex AI) is contractually prohibited from doing so on our behalf.
- You must not submit Content that:
- Contains personal information (including sensitive data) of others
- Is defamatory, discriminatory, hateful, or solicits criminal conduct
- Infringes copyright, rights of publicity, or other rights
- Contains malware or code that impairs system integrity
- We may remove violating Content and suspend the offending Account, and take legal action where applicable.
7. Special AI-Analysis Terms
- AI Analysis operates only after we obtain your separate explicit consent.
- When you use AI Analysis, your journal and chat content will be transmitted to Google Vertex AI as a cross-border transfer to the United States and other countries where Google LLC operates data centers (see Privacy Policy §4 for the destination countries and safeguards).
- You may withdraw AI-analysis consent at any time via Settings. After withdrawal, new analyses and chat replies will be unavailable. Previously generated analyses are retained until you delete them.
- You acknowledge that AI has the following limitations:
- Output may be inaccurate, biased, or inappropriate
- It must not be interpreted as professional medical, legal, or financial advice
- It may reflect cultural or demographic bias
- When the text you submit contains signals related to a personal crisis (such as self-harm or suicide), we may display safety resources (hotlines, etc.) on screen at the time the text is saved (or sent). This detection runs on your device; the result is not stored on our servers and is shown only on screen on a temporary basis. The display is purely informational, does not constitute intervention, counseling, or diagnosis, and — being based on automated text analysis — is not guaranteed to detect every crisis signal.
8. Connect Community Rules
Unlike journals and chats, Connect deals with content that is published to other signed-in Users, so the following additional rules apply.
- Visibility and disclosure: Posts, comments, replies, and reactions you submit to Connect are visible to all signed-in Users of the Service. Take care not to include personal identifiers, contact details, diagnostic labels, or any other information you wish to keep private. Even after deletion, content may persist briefly in caches or search indexes outside our direct control.
- Categories: Free-talk, Question, and Feedback categories are open to all signed-in Users. The Notice category is reserved for administrators ("admins") designated by the Company.
- Reply depth: Replies are limited to one level only (similar to Instagram and YouTube). You cannot reply to a reply.
- Prohibited conduct: In addition to the prohibited Content listed in §6.4, you must not:
- Insult, discriminate against, harass, or dox other Users
- Post spam, repetitive content, or promotional material
- Spread unverified medical/pharmacological assertions or misinformation
- Publish another person's photo, real name, or contact details without their consent
- Provide explicit descriptions or encouragement of self-harm or suicide methods
- Reactions and reports: You may react (like) to other Users' posts and comments, or report them for self-harm risk, harassment, spam, misinformation, or other reasons. Repeated or duplicate reports against the same target, or abuse of the reporting system, may result in restrictions on your reporting privileges.
- Moderation actions: Based on reports or our own monitoring, the Company (admins) may take the following actions:
- Hidden: Temporarily restricted to the author and admins during review
- Removed: Permanently restricted as a policy violation. Other Users see "Deleted item" in place of the content; the author is notified by email.
- You may appeal a moderation decision by emailing info@akaintelligence.com.
- Prioritization filter: To protect other Users, posts and comments are scanned with keyword-based detection at submission time, and matching items are prioritized in the admin moderation queue. This filter is not a definitive safety mechanism and may be circumvented.
- Repeat violations: For repeated policy violations or sustained reports, the Company may temporarily or permanently restrict your ability to post, react, or report on Connect.
- Notification emails: We will send activity emails when someone comments on your post, replies to your comment, or your content is moderated. Moderation notifications are sent regardless of preference for safety and policy reasons; other notification types can be turned off per category in Settings (see §5.4).
- Connect content and AI: Unlike journals and chats, Connect posts and comments are not used for AI analysis or model training and are not transmitted to Google Vertex AI or other external AI providers.
9. Paid Services

Paid Subscription: We offer certain features as a paid subscription ("Plus"). Pricing, billing intervals (monthly/annual), payment methods, and applicable currencies are disclosed on the checkout page. Payments are processed by our designated payment processor (e.g., Stripe).

Auto-Renewal and Cancellation: Plus subscriptions renew automatically at the end of each billing interval, and the registered payment method will be charged on the renewal date. You may cancel auto-renewal at any time from the subscription management screen; if you cancel, your Plus access remains active until the end of the already-paid billing interval, after which your account is automatically downgraded to Free. Pro-rated refunds are not provided (without prejudice to mandatory refund rights described in clause 5).

Failed Payments: If the automatic charge against your registered payment method fails, we will notify you by email and may retry the charge during a grace period. If payment is not completed within the grace period, the subscription will end and your account will be downgraded to Free.

Price Changes: We may change the price of Plus from time to time. For existing subscribers, we will give at least 30 days' prior notice by email or in-service notice before the new price applies to your next renewal. If you do not agree to the new price, you may cancel auto-renewal before the effective date.

Cooling-Off and Refunds: You have the right to withdraw your order (cooling-off) under applicable consumer-protection laws (e.g., Korea E-commerce Act, Japan Act on Specified Commercial Transactions). Due to the nature of digital content, withdrawal may be limited where:
- You have already used core features such as AI analysis or Muse Chat after purchase (irreversible consumption)
- The digital content has been fully delivered
Refunds will be processed in accordance with applicable laws and our published refund policy. Nothing in these Terms excludes refund rights granted by mandatory law. Refund inquiries can be sent to info@akaintelligence.com.

Fair Use Policy (FUP): Features marketed as "unlimited" on paid plans (e.g., Muse Chat) are provided for ordinary personal use, and undisclosed daily caps may apply to safeguard system stability and prevent abuse. Where excessive use is detected, we may temporarily limit the affected feature or display a notice.

Downgrade to Free: When a subscription ends and your account is downgraded to Free, access to paid-only features (full trend chart, unlimited data export, etc.) is restricted. Content you have created (journal entries, chats, analyses) is preserved and becomes accessible again upon resubscribing to Plus.

Taxes: Listed prices may include or be subject to additional indirect taxes (such as VAT) depending on your jurisdiction. The final charged amount will be shown at checkout.
10. Restrictions and Termination
We may restrict or terminate your use of the Service if you:
- Violate these Terms
- Infringe others' rights
- Endanger other Users, the Company, or third parties
- Disrupt Service operation (DDoS, scraping, etc.)
- Violate applicable law
11. Disclaimers and Limitation of Liability
- We are not liable for Service interruptions, data loss, or other damages caused by force majeure, including natural disasters, war, failure of telecommunications carriers, or outages of AI providers.
- We assume no legal liability for your decisions (including medical or psychological judgments) based on AI output. AI responses must not replace professional advice.
- Except in cases of willful misconduct or gross negligence, our aggregate liability shall not exceed the greater of (a) amounts you paid to us in the six months preceding the claim, or (b) USD 100—unless applicable consumer-protection law provides otherwise.
- Nothing in this Section limits rights granted to you by mandatory consumer-protection statutes (Korean Consumer Protection Act, Japanese Consumer Contract Act, US UCC / state consumer laws, etc.).
12. Privacy
Your personal information is protected under our separate Privacy Policy. By agreeing to these Terms, you acknowledge you have read that Policy. Separate consent for sensitive mental-health data is obtained at sign-up and again upon first use of AI Analysis.
13. Account Deletion
- You may delete your Account at any time via Settings.
- Upon deletion, all of your Content (journals, chats, analyses, Connect posts, comments, and reactions) is permanently erased and cannot be recovered.
- Consent-audit records (IP, User-Agent, timestamps) will be retained for the period mandated by law for dispute resolution (see Privacy Policy §5).
- Connect content that other Users have already quoted, screenshotted, or copied externally may remain outside our control after deletion. Please consider this when posting.
14. Intellectual Property
- All intellectual-property rights in the Service—trademarks, logos, software, UI, text, images—belong to the Company or its licensors.
- You may not reproduce, distribute, modify, or reverse-engineer Service components except for personal, non-commercial use.
15. Governing Law and Jurisdiction
- These Terms are governed by the laws of the Republic of Korea, except where mandatory consumer-protection law in your jurisdiction requires otherwise.
- For disputes, the first-instance court of competent jurisdiction shall be the Seoul Central District Court, Republic of Korea, unless your local law provides for a different mandatory forum.
- Users residing in the EU, Japan, or the United States retain their rights to seek redress from local consumer-protection agencies.
16. Miscellaneous
- If any provision is held invalid, the remaining provisions will remain in effect.
- Our failure to enforce any right is not a waiver.
- Matters not addressed here are governed by applicable law and our separate policies.
